In a move aimed at enhancing transparency and addressing potential drug trafficking links, 75 members of Chile's Congress were recently subjected to drug testing. This initiative follows the approval of a new law in July, mandating drug and narcotics testing for serving deputies. The testing process involved a random selection of legislators who underwent hair follicle tests to detect substances such as THC, cocaine, benzodiazepines, amphetamines, methamphetamines, and opiates

The legislation has sparked significant debate among political parties in Chile. Members of the progressive Frente Amplio party, which includes President Gabriel Boric, expressed their dilemma over the law. They feared that opposing it might be perceived as a stance against transparency. Conversely, conservative figures like Juan Antonio Coloma from the Independent Democratic Union supported the measure, suggesting that drug use could lead to extortion risks for lawmakers

The drug tests, conducted on the selected legislators, yielded negative results across the board, as reported by La Tercera. However, three deputies did not participate in the testing. Marisela Santibáñez, Clara Sagardía, and Jorge Durán, who were absent from the tests, now face the Ethics Committee of the Assembly. While Santibáñez and Sagardía have filed legal challenges against the testing regulation, Durán was out of the country during the testing period

The controversy surrounding the drug testing has led to discussions about privacy rights and the implications of such regulations on personal freedoms. The deputies who filed legal challenges argue that the regulation infringes on fundamental rights, including physical and psychological integrity and privacy. This aspect of the law has fueled further debate about the balance between transparency and individual rights within governmental oversight

Looking ahead, the remaining 77 deputies are scheduled to undergo drug testing in the coming weeks. This ongoing process is expected to further the conversation on drug use and regulation in Chile, potentially paving the way for more comprehensive discussions on cannabis legalization. As highlighted by legislator Jaime Sáez, who openly uses cannabis recreationally for medical reasons, there is a need for a deeper debate on cannabis consumption in Chile, where millions are regular users
