The International Cannabis Business Conference (ICBC) in Berlin 2023 was a pivotal event, drawing thousands of attendees to discuss Germany's evolving cannabis market. Held at the Estrel Berlin Hotel, the conference came shortly after Germany announced significant changes to its cannabis commercialization plans. This shift in policy sparked vibrant discussions among industry leaders about future business opportunities in Germany's cannabis sector

Peter Homberg, a partner at Dentons law firm, opened the conference by addressing the German government's recent proposals for an adult-use cannabis market. He explained that Germany had initially approached the European Commission with a plan in October 2022, which was ultimately rejected, leading to the development of a 'Plan B'. This alternative strategy, although disappointing to the industry, aligns with EU and UN agreements and includes the establishment of Cannabis Clubs and pilot studies

Homberg highlighted the practical challenges of implementing the first pillar of the new strategy, which involves the establishment of Cannabis Clubs. These clubs are projected to cultivate up to 300 kg annually. However, logistical issues, such as finding suitable locations away from schools in urban areas like Berlin, remain unresolved. The second pillar, involving pilot studies similar to those in Switzerland, also faces uncertainties regarding domestic production capabilities

Despite the setbacks, there are positive changes on the horizon. Proposed amendments to Germany's narcotics laws will remove cannabis-related substances from the list of controlled substances, potentially easing access for medical patients and prescribers. Though the timeline for implementing these changes remains uncertain, with expectations shifting from late 2023 to early 2024, the reforms could significantly impact Germany's medical cannabis market

Georg Wurth, head of the German Hemp Association, expressed skepticism about full legalization within the decade but remained optimistic about Germany's liberal stance on cannabis. He pointed out that Germany's proposed reforms could position it alongside Malta as one of the most progressive countries in Europe regarding cannabis policy. The conference concluded with discussions on the need for Germany to address its reliance on cannabis imports and the potential for domestic production expansion
