Seychelles Set to Implement Medical Cannabis Regulation by July 2023

The Seychelles is on the brink of a significant shift in its medical cannabis policy, with new regulations expected to take effect on July 1, 2023. This development follows the introduction of the Misuse of Drugs (Cannabidiol-based Products for Medical Purposes) bill in February, which aims to regulate the use of cannabidiol (CBD) for medical purposes. The bill's approval by the National Assembly is the final step needed before the regulations become law

The journey towards medical cannabis regulation in the Seychelles has been long and arduous. It began in 2017 when Ralph Volcère filed a petition with the Constitutional Court on behalf of his mother, who used cannabis oil to manage Alzheimer's symptoms. In a landmark decision in June 2019, the court ruled in favor of Volcère, mandating the government to establish a legal framework for medical cannabis use

Ralph Volcère has expressed cautious optimism about the new regulations. While he acknowledges the progress made, Volcère criticizes the regulatory framework as overly restrictive and bureaucratic. "The procedure for accessing medical cannabis is extremely bureaucratic and unnecessary," he stated, highlighting the exclusive discretionary power given to the health commissioner to decide who can access cannabis-based treatments

Volcère also pointed out several shortcomings in the proposed regulations. Notably, there is no list of qualifying medical conditions for cannabis use, nor is there clarity on the pricing of CBD products. Furthermore, the regulations prohibit the smoking of cannabis for medical purposes, a common method of consumption for many patients

Looking ahead, Volcère and other advocates are hopeful that the National Assembly will address these concerns to create a more progressive and inclusive policy. There is also a push for the regulations to eventually allow for the local cultivation of cannabis, which would reduce the need for imports and potentially lower costs for patients. As the Seychelles moves forward, the eyes of the global cannabis community will be watching closely
